Terms of Service

1. Introduction

These Terms of Service govern the relationship between MadeByGohar (operated by Gohar, based in Pakistan — "we", "us", "our") and any individual or business ("you", "the client") who engages our web design services.

By submitting a contact form, requesting a mockup, making payment, or otherwise engaging our services, you agree to these terms in full. If you do not agree, please do not proceed.

2. Services

MadeByGohar provides website design and development services for small service businesses. Our work includes but is not limited to: website design, template customisation, contact form setup, mobile responsiveness, basic on-page SEO structure, and site deployment.

We do not provide: ongoing SEO campaigns, paid advertising, social media management, copywriting (beyond light editing), photography, custom software or app development, or e-commerce / payment processing systems.

All prices are in USD. Final pricing is confirmed in writing before any work begins. We reserve the right to adjust pricing for projects that significantly exceed the described scope, with client notification and agreement before proceeding.

3. The free mockup

We offer a free mockup — a visual preview of your website — before any payment is required. The mockup is intended to show you what your site will look like so you can make an informed decision.

You are under no obligation to pay for anything after receiving the mockup. If you don't like it, you walk — no invoice, no follow-up.

The mockup is a design preview only and does not constitute a live, functional website. Features shown in the mockup may vary slightly in the final build due to technical constraints.

We reserve the right to decline to produce a mockup if we determine the project is not a good fit for our services.

4. Project process

4.1 What you provide

To begin work, you must provide: your business name, services offered, prices (if you want them shown), contact details, and any photos or brand assets you have. The delivery clock starts when we have received all required content — not when you first make contact.

Delays caused by late or incomplete content provision are not our responsibility and will extend the delivery timeline accordingly.

4.2 Delivery timeline

Delivery timelines (48 hours for Intro/Standard, 7 days for Custom) are targets based on prompt content provision and clear communication. They are not legally binding guarantees. We will notify you as soon as possible if a delay is expected.

4.3 Revisions

A "revision" means one round of consolidated feedback applied to the delivered site. A round of revision covers reasonable changes to text, layout, colours, and images. It does not cover:

Additional revisions beyond what's included in your tier are available at a flat rate, quoted before work begins.

4.4 Post-delivery small edits (Standard and Custom)

"Small edits" during the 30-day post-delivery period covers: text changes, price updates, photo swaps, and minor layout tweaks. It does not cover adding new pages, significant restructuring, or feature additions. The 30-day period begins from the date the live site is delivered to you.

5. Payment

Payment is required in full before the live site is handed over to you. We do not accept partial payments or payment plans unless agreed in writing beforehand.

Accepted payment methods will be confirmed at the time of invoicing. All payments must be made in USD. Bank fees and currency conversion costs are the client's responsibility.

Invoices are due within 7 days of issue. We reserve the right to withhold the live site until payment is received and cleared.

6. Refunds and cancellations

6.1 Before payment

If you decide not to proceed after receiving the mockup and before making any payment, no charge applies. You are free to walk away at any point before payment.

6.2 After payment, before delivery

If you cancel after payment but before the live site has been delivered, we will refund 50% of the amount paid. The remaining 50% covers the design and development work already completed.

6.3 After delivery

Once the live site has been delivered and handed over to you, no refunds are available. If you have concerns about the delivered work, please contact us directly and we will work to resolve the issue within the terms of your revision entitlement.

6.4 Exceptional circumstances

We handle disputes on a case-by-case basis and will always try to reach a fair resolution. If you believe you are entitled to a refund outside of these terms, contact us at gohar@madebygohar.com.

7. Intellectual property and ownership

7.1 Your ownership

Upon receipt of full payment, you own the final website files, content, and design delivered to you. This includes all HTML, CSS, JavaScript, and image files that make up your site. You are free to modify, transfer, or host the site however you choose.

7.2 Third-party assets

If your site uses third-party fonts, icon libraries, stock images, or open-source code, those remain subject to their respective licences. We will inform you of any such assets and their licence requirements.

7.3 Our portfolio rights

We reserve the right to display your completed website in our portfolio, on our website, and in our social media as an example of our work. If you do not wish your site to be displayed publicly, notify us in writing before project commencement and we will honour that request.

7.4 Content you provide

You warrant that any content you provide (text, images, logos, branding) is either owned by you or that you have the legal right to use it on your website. You indemnify MadeByGohar against any third-party claims arising from content you have provided.

To the maximum extent permitted by law, MadeByGohar's total liability to you for any claim arising from our services is limited to the amount you paid us for those services.

10. Confidentiality

We treat all project-related information you share with us — business details, pricing, internal processes — as confidential. We will not share this information with third parties except where required by law.

We ask that you treat any processes, templates, or working methods we share during the project as confidential and not reproduce or share them commercially.

11. Governing law and disputes

These Terms of Service are governed by the laws of Pakistan. However, we recognise that our clients are located in multiple jurisdictions and we commit to handling disputes in good faith regardless of location.

In the event of a dispute, we ask that you first contact us directly at gohar@madebygohar.com to seek a resolution. We aim to respond to all dispute notices within 5 business days.

If a dispute cannot be resolved directly, it may be referred to mediation before either party pursues legal action.

12. Changes to these terms

We may update these Terms of Service from time to time. The terms in effect at the time you engage our services (i.e. at the time of payment) are the terms that govern your project. Updated terms apply to new projects only.
